Legal input to bid preparation is often left late. If the bidder has an in-house legal department, the legal sign-off may be seen as a barrier rather than a constructive part of the process.
We believe the bid lawyer should be an integral part of the team from the start. The lawyer has to be practical, commercial and experienced in this specialised area. The extent of involvement will vary widely according to the nature of the bid.

- Assess the contractual risks and other potential legal issues with the bid team at the initial stage, before the decision to bid and before significant resources are committed.
- Negotiate or clarify the contract in the bidder’s favour, so far as the bid process allows (which is often further than you may think)
- Coordinate the remaining major risks with the company’s insurance programme.
- Help the bid team and the delivery team to gain sufficient understanding of the contract to deliver the project effectively
- Supply on going advice as and when required during the period of performance
- Learn from past mistakes and take measures to avoid repetition.
